Lleida, 10 de mar\u00e7 de 2020.<\/p>\n

El Jutjat de Primera Inst\u00e0ncia n\u00famero 6 de Lleida ha dictat la primera sent\u00e8ncia a la demarcaci\u00f3 de Lleida que declara nul per abusiu l’\u00edndex de refer\u00e8ncia IRPH, i ho fa en aplicaci\u00f3 de la doctrina comunit\u00e0ria fixada en la sent\u00e8ncia del 3 de mar\u00e7 de 2020 del Tribunal de Just\u00edcia de la Uni\u00f3 Europea.
\nLa resoluci\u00f3, acollint els arguments jur\u00eddics de la part demandant, representada per l’advocat del nostre despatx, Marc Torres, conclou que la cl\u00e0usula del pr\u00e9stec per la qual s’estableix l’index IRPH com a refer\u00e8ncia del tipus d’inter\u00e9s, no supera el control de transpar\u00e8ncia, ja que l’entitat banc\u00e0ria demandada no ha pogut acreditar que inform\u00e9s al consumidor sobre el m\u00e8tode de c\u00e0lcul i la composici\u00f3 de l’\u00edndex, aix\u00ed com tampoc sobre la seva evoluci\u00f3 passada en comparaci\u00f3 amb altres \u00edndex.
\nCom a conseq\u00fc\u00e8ncia de la nul\u00b7litat de la cl\u00e0usula, condemna al banc a deixar d’aplicar aquest \u00edndex i a substituir-lo per l’Euribor, i a retornar al client tots aquells interessos que hagu\u00e9s abonat en aplicaci\u00f3 de l’IRPH.<\/p>\n
